For the past two years, we saw some notable decisions which should form part of this book. For instance, in March, 2023 (released in February 2024), the Highest Tribunal laid down the rules in determining discernment involving child in conflict with law (CICL). In this En Banc ruling, the definition and nature discernment under R.A. No. 9344 were discussed lengthily thus affecting the rules on minority, both as exempting and mitigating circumstances. Another milestone is the case of Westfall where the concept of Generality was involved. The case involved personnel of the Asian Development Bank who are immune from local laws. Finally, the discussion of the Court on the special qualifying aggravating circumstances in People v. ABC260708 is part of this newest edition.
