The fourth edition sees the expanded discussion on the concept of negligence per se and the doctrine of attractive nuisance.
There are also new cases that were discussed in this new edition. The case of Apolinario v. Heirs of Delos Santos (G.R. No. 219686, November 27, 2024) is one of them. In the said case, the author’s view that the vicarious liability cannot be limited to the teacher-in-charge if the school is an academic institution as discussed in the case of Amadora v. Court of Appeals (G.R. No. L-47745, April 15, 1988) has been strengthened. The case of Apolinario has provided that if the one who caused the injury or damage is an unemancipated minor, the ones to be held liable are the school, its administrators, and teachers while the said minor is under their supervision and custody.
