Description

Three years after its last revision in 2022, the author felt the need to revise this two-part series of Criminal Law Concepts and Jurisprudence, Book Two, Revised Penal Code. During the interregnum, the Highest Tribunal rendered decisions which are relevant in the field of criminal law. Some notable of which are the cases of People v. Batislaon (2023) which changed the concept of Qualified Theft, People v. Balsamo (2023) which distinguished Direct Assault from Resistance and Serious Disobedience to Person or Agent of Person in Authority, People v. Camarse (2023) on the qualifying circumstance of Murder, People v. Agao (2022) redefining carnal knowledge on Rape by Sexual Intercourse, People v. Thanaraj (2024) on Parricide, Valencia v. People (2024) on the crime of Adultery, People v. Miranda (2023) on Qualified Rape, People v. Catacutan (2023) on Robbery with Homicide, and many others. The importance of these decisions did not escape the attention of the bar examiners of the 2024 bar examinations and prompted them to ask questions taken from these rulings.
