Thus, the author traced the history of our Criminal Procedure. It was introduced on December 17, 1886 by the Spanish government. The system was inquisitorial pursuant to Ley Provisional del Procedimento Criminal. During the American Regime, the Philippine Military Governor issued General Order No. 58 known as Code of Criminal Procedure wherein the system was adversarial. In 1940, the Supreme Court promulgated the 1940 Rules of Court (Rules 106 to 122). The procedure was a combination of the inquisitorial and adversarial systems. Then came the 1964 Rules of Court (Rules 110 to 127). Eventually on various dates, these Rules were followed by Interim Rules and Guidelines dated January 11, 1983; the 1985 Rules on Criminal Procedure (Rules 110 to 127); the 1988 Amendments to the 1985 Rules on Criminal Procedure; the 1991 Revised Rule on Summary Procedure; and the 1994 Amendment of Rule 114 on bail.
