• Rules on Criminal Procedure Annotated

As explained and emphasized by the Supreme Court, it resolved to recognize the authority of the Department of Justice to promulgate its 2024 DOJ-National Prosecution Service Rules on Preliminary Investigations and Inquest Proceedings (2024 DOJ-NPS Rules). It must be stressed that the promulgation of the DOJ-NPS Rules would not ipso facto repeal Rule 112 of the 2000 Rules. It is settled that only the Supreme Court could repeal Rule 112 of the 2000 Rules, but to remove the impediment that the present Rule 112 seems to impose upon the promulgation of the DOJ-NPS Rules, and in recognition of the DOJ’s authority to promulgate its own rules on preliminary investigation, as ruled by the Supreme Court, the repeal of the pertinent provisions under Rule 112 of the 2000 Rules inconsistent with the DOJ-NPS is warranted.

  • Annotations and Jurisprudence on Criminal Procedure

Consequently and after writing my recent book on Evidence, I was emboldened to follow this up with Criminal Procedure. As I have been doing litigation since I was admitted to the Bar in 2010, plus the prior years where I worked as paralegal and researcher, I want to reduce some of my knowledge and experience in writing, for me to share my thoughts and views on practice and pleadings for the student of the law and legal practitioners.

His new Book on Criminal Procedure has again shown what a truly gifted writer can do in the treatment of a subject matter which every legal practitioner should know by heart. Not every writer on the subject is as qualified as he is on the subject. Primer-Reviewer on Remedial Law Vol. 2, Special Proceeding, Criminal Procedure and Evidence

The present edition continues the use of the Q&A format which serves the dual purpose of not only refreshing the reader’s knowledge of legal theory but also hones and sharpens his or her test-taking skills of fact-pattern recognition, analogy, and deduction. I have always maintained that legal rules and case holdings are best absorbed for deployment in the bar and law examinations by studying them not in isolation but in the context of their underlying fact-patterns.
