Description
The amendments of the 1997 Rules of Civil Procedure by the Supreme Court of the Philippines effective May 1, 2020 and the passage of Republic Act No. 11054 otherwise known as the Bangsamoro Organic Law call for the revision of this humble work. There were substantial changes in the rules of pleading and in the jurisdiction of the Shari’a courts brought about such issuances. In addition, I have expanded the annotations of the Special Rules to minimize the reader’s effort in referring back to the provisions of the Rules of Court.
In this edition, I have also endeavoured to enrich and expand Dr. Abdul Rahim’s treatise on the Muslim Law on Evidence from other sources, notably the work of Dr. Anwarullah, Senior Advisor to the Federal Shariat Court of Pakistan, entitled “Islamic Law on Evidence,” the “Al-Majalla al-Ahkam al-Adaliyyah (The Ottoman Courts Manual)” more popularly known in English as the Mejelle, and the Al-Hidaya (A Commentary of Muslim Laws with English translation by Charles Hamilton) in order to widen the student’s perspective over the subject thereby adequately prepare him for the special Shari’a bar examinations and for practice before the Shari’a courts in the Philippines. May Allah, the Most High and the Most Exalted, reward them for their efforts.
