The Writ of Habeas Data 2025

This book discusses on the elements, basic concepts, and jurisprudential rules relative to the different judicial remedies involving real properties. It also delineates the distinctive features and characteristics of each remedy vis-àvis the others. It strives to be a reliable guidebook for the reader in order for him/her, first, to select the most appropriate and effective remedy under obtaining circumstances and, second, to formulate the factual allegations apropos to the chosen remedy. Let it be emphasized that a wrong remedy is fatal to one’s cause of action and could lead to the dismissal of the complaint. Similarly, even if the correct action was taken, yet, the complaint fails to set out key and material or jurisdictional facts, such dearth would be equally disastrous and could lead to a similar result.

Last October 2020, the first edition of this book went into print. Due to several updates on the law and jurisprudence on human trafficking, this is now an opportune time to come up with the second edition. First, the passage of R.A. 11862 which expanded the previous anti-human trafficking laws became effective last June 2022. The Expanded law significantly added several definitions aimed to penalize modern ways of committing human trafficking such as Online Sexual Abuse and Exploitation of Children and use of Child Sexual Exploitation of Children among others. Also, the Expanded law provides more protection against vulnerable members of our society such as persons with disability or a member of an indigenous community.
